New Public Procurement Law

The new Public Procurement Law (“PPL”) and its Regulation for implementation are effective as of today.

The procedures for award of public procurement, for execution of framework agreements and for projects’ tender that have been initiated before 15 April 2016 will be completed according to the repealed law. The former rules shall be applicable as well to the hearing of appeals submitted to the competent authorities before this date.

It should be noted that the concluded before the new PPL effective date agreements for award of public procurement and framework agreements will be amended and terminated in accordance with the art. 116 and art. 118 of the new PPL.

The movement of the legal provisions concerning the conduct and organization of public procurement procedures in the newly adopted Regulation for implementation of PPL is at least an odd and unusual legislative decision.
